These are the Terms & Conditions upon which F.O.O.D Week Incorporated (“F.O.O.D”) ABN 25 069 215 997 permits you to use this website. By using this website you agree to be bound by these Terms & Conditions, as modified by F.O.O.D from time to time.

In these Terms & Conditions “we”, “our and “us” means F.O.O.D Week Incorporated ABN 25 069 215 997 of PO Box 2229 ORANGE NSW 2800 and “you” and “your” means you the customer.

These Terms & Conditions together with your order constitute the entire Contract between us and you for the supply of products. No other Terms & Conditions will apply. The Contract cannot be varied unless we agree to vary it in writing or by email.

By placing an order, you make an offer to us to purchase the products you have selected based on these Terms & Conditions.

If you are under the age of eighteen (18) years you can not place an order with us. By accepting these Terms & Conditions you acknowledge that you are over the age of eighteen (18) years of age.

If we suffer any damages or other losses as a result of a transaction entered into by a minor, we reserve the right to seek compensation for such losses from the parents or guardians of the minor who placed the order(s).

Product Description

F.O.O.D attempts to describe all products and services as accurately as possible, however F.O.O.D does not warrant that product descriptions or other content of this site is accurate, complete, reliable, current or error-free. If a product offered by F.O.O.D is not as described, your sole remedy is to return it in an unused condition. From time to time F.O.O.D may limit the number of items that can be purchased at any one time e.g. event tickets. At such time F.O.O.D reserves the right to cancel, refund or decline any purchases which are deemed to be in breech of the stated limit either by intentional, unintentional or fraudulent means.

Colour Description

We have made every effort to visually match the colours of our products however the actual colours you see online are indicative only and will depend on your monitor. As such we cannot guarantee that the monitors’ display of any colour will reflect the products colour correctly or entirely.

Pricing & GST

F.O.O.D strives to provide accurate product and pricing information however despite our best efforts, from time to time, some products may be incorrectly priced. If an item’s correct price is higher than our stated price we will at our discretion either contact you for instructions before shipping or cancel your order and notify you as such.

All prices are in Australian dollars and purchases include GST unless otherwise stated on our product listing.

Payment Methods

F.O.O.D currently only accepts payments via the Pay Pal online payment system.

Risk of Loss

All items purchased from F.O.O.D online are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.

RETURN & REFUND POLICY

F.O.O.D prides itself on the quality of its products and level of customer service however if, for any reason, you are not completely satisfied with your purchase (excludes event tickets), you may return it and we will happily refund your money, or send you a replacement. We do however ask that the product is returned to us within 21 days of purchase, is returned in its original condition and packaging and is accompanied by the original invoice or receipt. Refunds will not be made without proof of purchase and not before receipt by us of the returned goods.

We will only pay refunds by cheque to you and sent to your mailing address.

Delivery and packaging charges are not refundable unless as a result of our error or faulty item.

Please note that F.O.O.D cannot be responsible for returned items that may be lost in transit.

Please allow up to 21 working days from when you send the product for your money to be reimbursed.

Exchange Items

If you received a faulty item or would like to exchange an item for a different one (excludes event tickets), simply place another order for the desired item and return the faulty item to us. Delivery and packaging charges are not refundable unless as a result of our error or faulty item.

Delivery Delays

Unforseen supply problems or unexpected demand may occasionally result in stock being unavailable.

Should there be a delay in despatching your order we will contact you immediately to advise you or the reason for the delay. You may cancel such an order at any time prior to processing.

Apart from fair dealing permitted by the Copyright Act 1968, visitors to this website are permitted to download and display any of the Information for private purposes only.
